Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and Website Killer ("we", "us", "our") governing your access to and use of our AI website builder service, including the website at websitekiller.com, our APIs, our hosted projects, and any related services (together, the "Service"). By signing up, signing in, or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.

2. Account

You're responsible for the security of your account, the accuracy of the information you provide, and any activity under your account. One human per account; sharing logins violates these Terms. You must be at least 16 years old to use the Service.

If you discover unauthorized access, notify us immediately at security@websitekiller.com.

3. Acceptable use

You may not use Website Killer to:

  • Host or distribute illegal content, including but not limited to CSAM, malware, phishing kits, or fraud-as-a-service infrastructure
  • Send spam, mass unsolicited email, or run unauthorized email-marketing campaigns
  • Infringe third-party intellectual property, including trademarks and copyrights
  • Impersonate any person or entity, or misrepresent your affiliation
  • Attempt to gain unauthorized access, scrape at scale, or reverse-engineer the Service
  • Resell or sub-license the Service to third parties without our written agreement
  • Bypass rate limits, plan limits, or token caps via automation or other means

We may suspend or terminate accounts engaged in any of the above without prior notice and may report illegal activity to law enforcement.

4. Your content

You retain ownership of the content you create with the Service ("Your Content"), including the websites you generate, the prompts you submit, and any media you upload. You grant us a worldwide, non-exclusive, royalty-free license to host, render, generate, transmit, and serve Your Content as needed to operate the Service.

You're responsible for making sure Your Content is legal, doesn't infringe third-party rights, and complies with these Terms.

5. AI output

Website Killer uses AI models from third-party providers (Anthropic, OpenAI) to generate websites, copy, and chat-edits. AI-generated content is provided "as is" — review it carefully before publishing. You are responsible for:

  • Reviewing AI output for accuracy and legality
  • Ensuring AI-generated content doesn't infringe third-party IP
  • Making sure AI-generated claims about your business are true
  • Compliance with any AI-disclosure laws applicable to your jurisdiction or industry

We don't claim ownership of AI output you generate via your account.

6. Our intellectual property

The Service itself, including the design system, the templates we ship, the user-interface code, our brand, our logos, our trademarks, and any technology behind the Service, is owned by us and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is in good standing. Source-code export of generated projects is permitted; redistributing our templates or brand as your own product is not.

7. Billing & subscriptions

Paid plans renew automatically on the same calendar day each month (or annually for annual plans) at the then-current price. You authorize us to charge your payment method on file via Stripe.

You can cancel anytime from the billing portal. Cancellation stops the next renewal — you keep access through the end of the current billing period.

We may change pricing with 30 days' notice. Existing subscriptions retain their pricing until the next renewal after the change.

8. Refunds

We offer a 14-day money-back guarantee on the first month of any paid plan, no questions asked. After 14 days, refunds are evaluated case-by-case. Token usage already consumed is not refunded.

9. Token limits

Each plan includes a monthly AI token allowance. We total provider-reported input and output tokens across AI generation, chat edits, and prompt tools. Limits reset on the first day of each calendar month (UTC).

If you exceed your limit, AI features pause until the next reset or you upgrade. We do not auto-charge for overages without your explicit consent.

10. Custom domains

Paid plans include custom-domain support. You are responsible for owning and maintaining your domain registration. We provision SSL certificates via Let's Encrypt for connected domains.

Each plan includes a fixed number of "domain slots." A nameserver-connected domain with both apex and www counts as one slot.

11. Service availability

We aim for high availability but don't guarantee uninterrupted access. Scheduled maintenance, third-party provider incidents, and force majeure events may interrupt the Service. We don't owe service credits for these interruptions unless explicitly stated in a separate enterprise agreement.

12. Termination

You may close your account anytime — your data is deleted within 30 days of closure (see our Privacy Policy for retention details).

We may suspend or terminate accounts that violate these Terms, with or without notice. For material service-wide changes that reduce paid functionality, we provide at least 30 days' advance notice.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR- FREE, OR ENTIRELY SECURE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WEBSITE KILLER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE. OUR TOTAL LIABILITY IS LIMITED TO THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

15. Indemnification

You agree to indemnify and hold us harmless from any third-party claim arising out of Your Content, your use of the Service, or your violation of these Terms or any law.

16. Changes to these terms

We may update these Terms. Material changes will be announced via email or in-product notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

17. Governing law

These Terms are governed by the laws of the jurisdiction in which Website Killer is registered, without regard to conflict-of-law rules. Disputes that cannot be resolved by good-faith negotiation will be resolved in the competent courts of that jurisdiction unless mandatory consumer-protection law in your home country provides otherwise.
